新就业形态一站式劳动纠纷调解中心的构建和运行研究

摘要 与仲裁、诉讼相比,调解制度能够在平台及其合作企业与新就业形态劳动者之间寻找最佳利益平衡点,并弥补当前立法供给不足的缺陷。由此,有必要建立专门化的调解组织——新就业形态一站式劳动纠纷调解中心。以人社部门牵头,通过“独立式”与“嵌入式”双轨模式,结合新就业形态特点,实现线上线下流程并行;同时完善基础设施建设、加大财政支持力度、建设专业调解队伍,并加强与仲裁、诉讼的协调衔接,改善配套机制,最终构建高效率、低成本、可信赖的一站式调解中心。 Compared with arbitration and litigation,the mediation system can help find an optimal balance of interests between platforms and their partner enterprises on the one hand,and workers engaged in new forms of employment on the other,It also compensates for the current insufficiency in legislative support.Therefore,it is necessary to establish a specialized mediation organization—the One-Stop Mediation Center for Labor Disputes in New Forms of Employment.Led by the human resources and social security authorities,the center should adopt a dual-track model that combines both"independent"and"embedded"approaches,integrating online and offline procedures in light of the characteristics of new employment forms.At the same time,efforts should be made to improve infrastructure,increase financial support,build a team of professional mediators,and strengthen coordination with arbitration and litigation mechanisms.By improving the supporting systems,a highly efficient,low-cost,and reliable one-stop mediation center can ultimately be established.
