本文聚焦生成式人工智能(GenAI)在著作权领域引发的核心法律挑战,系统分析了其在数据输入与内容输出两个阶段存在的版权争议。文章通过剖析具体案例,深入探讨了美国著作权法律体系下“合理使用”的界定标准与司法实践。在系统梳理Thomson Reuters v.Ross Intelligence案件及Authors Guild v.Anthropic案件后,揭示了美国司法实践中对“转换性使用”和“市场替代效应”等关键问题的判定逻辑。本文认为,生成式人工智能下的版权治理应在激励创新与保护原创之间寻求动态平衡。
This paper focuses on the core legal challenges posed by Generative AI(GenAI)in the field of copyright,systematically analyzing the copyright disputes arising in two phases:data input and content output.By examining specific cases,the article delves into the definition standards and judicial practices of"fair use"under the U.S.copyright legal system.After a systematic review of cases such as Thomson Reuters v.Ross Intelligence and Authors Guild v.Anthropic,it reveals the judicial reasoning in U.S.courts regarding key issues including"transformative use"and"market substitution effect."This paper argues that copyright governance in the era of Generative AI should strive for a dynamic balance between incentivizing innovation and protecting original works.
