摘要
地方人大及其常委会的法规性决定是地方人大及其常委会在当前时代背景下渴望通过立法有所作为的生动体现,基于法规性决定在地方社会治理过程中发挥的重要功能,部分地方立法已经对其进行了规范层面的确认。通过对法规性决定的实践样态进行梳理,能够发现法规性决定存在与人大普通决定认定标准不清晰、内容合法性保障不足以及与现行立法承接不顺畅等问题。这些问题不利于法规性决定重要功能的发挥,对地方立法工作也产生了不良影响,应当通过明确法规性决定的立法定位、厘定法规性决定与人大普通决定的关联与区分、完善相关立法以及优化相关制度运行予以解决。
Legislative decisions made by local people s congresses and their standing committees vividly reflect their aspiration to achieve legislative impact within the current era.Given the crucial role these decisions play in local social governance,some local legislatures have already formalized their legislative status through normative frameworks.An examination of the practical manifestations of legislative decisions reveals several issues:unclear criteria for distinguishing them from ordinary decisions of the people s congresses,insufficient safeguards for the legitimacy of their contents,and difficulties in aligning them with existing legislation.These issues hinder the important functioning of legislative decisions and adversely impact local legislative work.Solutions should involve clarifying the legislative positioning of legislative decisions,defining their relationship with and distinctions from ordinary decisions of people s congresses,improving relevant legislation,and optimizing the operational mechanisms of related systems.
