摘要
为丰富监察措施的“工具箱”,2024年12月修改后的《监察法》新增强制到案、责令候查、管护等措施。许多监察措施的运用有赖于公安机关的协助,这有利于反腐败合力的形成,但在实践中同样面临不少难题,主要表现为如何在配合之时施以有效监督,如何避免警力资源被过多占用,如何为协助行为提供规范依据,以及如何确定协助行为的法律责任。鉴于此,应有针对性地探求难题破解之道,包括探索公安机关对协助提请进行形式审查的机制,以兼顾“互相配合,互助制约”和“依法独立行使监察权”这两项宪法原则;合理界定协助范围并充实警力资源,以实现需求和供给的相对平衡;适时修改《人民警察法》并制定专门的监察法规,以此构建多层次的依法协助制度规范体系;根据具体协助行为背后的机关意志,以便分类确定责任归属和救济渠道。
To enrich the"toolbox"of oversight measures,the December 2024 Supervisory Law Revision introduced such new measures as compulsory appearance,ordered to await investigation,management and protection.While the effective implementation of these measures often requires collaboration with public security organs to enhance anti-corruption synergy,this cooperative mechanism presents several practical challenges,including exercising effective supervision during cooperating,avoiding excessive occupation of police resources,providing a normative basis for assistance,and determining the legal liability for assistance.To address these challenges,targeted efforts should be made.Namely,exploring a mechanism for public security organs to conduct formal review of assistance requests,so as to strike a balance between the two constitutional principles"mutual cooperation and mutual constraint"and the"independent exercise of supervisory power in accordance with the provisions of law";reasonably defining the scope of assistance and strengthening police resources to achieve a relative balance between demand and supply;amending the People's Police Law and enacting specialized supervisory statutes based on the Supervisory Law,for the purpose of building a law-based and multilevel system of assistance;and categorizing and determining the ascription of responsibility and channels of redress based on the will of the authorities behind specific acts of assistance.
