摘要
构建体育法学自主知识体系是构建中国自主的知识体系的必然要求。运用文献资料法、逻辑分析法等研究方法,以“人文关怀”为核心切入点,探究体育法学自主知识体系的理论框架、制度逻辑与实践路径。研究发现:1)当前,体育法学知识体系存在学科边界不清、价值目标不明、理论整合不够、话语体系“从属”等问题,其构建需要一个内在的价值引导系统;2)人文关怀与体育法学在本质诉求与制度使命上深度契合,呈现出以身体性、群体性、制度性为核心特征的复合型法理结构;3)人文关怀理念的体育法治实践,为其成为体育法学自主知识体系的价值指引提供了现实基础;4)人文关怀对体育法学自主知识体系构建具有明确体育法为何而建的价值取向和学术向度,推动体育法学从“治理中心主义”向“权利本位主义”转型,为体育法制度的理解与批判提供价值标尺等重要作用。研究建议:以人文关怀为价值基点构建体育法学自主知识体系。1)理论创新方面,构建人文关怀体育法学基本范式,形成体育法学话语体系;2)制度构建方面,建立本土经验与学术理论的双重支撑体系,实现从“经验治理”向“学理升华”的转化;3)理念践行方面,实现人文关怀从价值宣示到规范实施的转换;4)教育革新方面,将人文关怀理念融入体育法学教育与人才培养体系中。
The construction of an independent knowledge system of sports law is an inevitable requirement for building a independent knowledge system with Chinese characteristics.Using research methods such as literature review and logical analysis,this study takes“humanisticcare”as the core entry point to explore the theoretical framework,institutional logic,and practical pathways of the sports law knowledge system.The findings reveal that:1)the current sports law knowledge system faces problems such as unclear disciplinary boundaries,ambigu-ous value objectives,insufficient theoretical integration,and a"subordinate"discourse system,thereby necessi-tating an intrinsic value-guiding mechanism for its construction;2)humanistic care and sports law are deeply aligned in their essential pursuits and institutional missions,presenting a composite jurisprudential structure characterized by corporeality,collectivity,and institutionality;3)the practice of sports law under the guidance of humanistic care provides a realistic foundation for serving as the value guidance of the independent knowledge system of sports law;and 4)humanistic care plays an important role in clarifying the value orientation and academic perspective of why sports law should be established,promoting the transformation of sports law from"governance centralism"to a"rights-oriented fundamentalism",and providing a value benchmark for understanding and critiquing sports law institutions.The study recommends taking humanistic care as the value foundation for constructing the independent knowledge system of sports law.Specifically:1)in terms of theoretical innovation,it is essential to establish a fundamental paradigm of sports law grounded in humanistic care and to construct a disciplinary discourse system;2)in terms of institutional development,a dual-support system integrating local experience and academic theory should be established to enable the transition from"empirical governance"to"scholarly refinement";3)in terms of conceptual practice,the transformation of humanistic care from value declaration to normative implementation needs to be realized;and 4)in terms of educational reform,the concept of humanistic care should be integrated into the education and talent cultivation system of sports law.
