摘要
新兴领域是新兴事物产生、发展、变迁的时空场域,新兴领域立法是新兴领域治理的法治化表达。相较于其他领域立法,新兴领域立法在内容、功能、视野等维度具有显著的独特性,探索其底层逻辑有助于在中国式现代化进程中把握新兴领域立法的元点,纵深推进全面依法治国。新兴领域立法的底层逻辑兼具立法的普遍性与时代性双重特征,呈现“一总二分”的递进式结构。“一总”强调新兴领域立法在总体上应立足于“真实共同体”的权利本位价值指引;“二分”强调新兴领域立法须统筹好国内与国际的要素关系:在国内层面坚守以新发展为导向的义利平衡,在国际层面构建以新疆域为引领的全球治理新格局。推进新兴领域立法的底层逻辑,必须坚持系统观念,构建横向类型化、纵向层次化的交织浸入式体系,遵循整全性科学化、民主性专业化的立法思维与实践方法。
Emerging fields are the spatial and temporal arenas in which new things emerge,develop and change,characterized by a broad scope,rapid changes,and a global perspective.Legislation in emerging fields is the expression of the rule of law in the governance of emerging fields,and is an important element in promoting the rule of law in a comprehensive manner.Exploring the underlying logic of emerging fields legislation is conducive to grasping the meta-point of legislation in emerging fields in the process of Chinese-style modernization.The underlying logic of legislation in emerging fields is characterized by both universality and modernity of legislation,following the progressive structure of"one general and two divisions".The"one general"emphasises that legislation in emerging fields should,on the whole,adhere to the value guidance of the rights-based approach based on the"real community";the"two divisions"emphasises that legislation in emerging fields should integrate the relationship between domestic and international elements.The"two divisions"emphasise the need for legislation in emerging areas to integrate the elements of domestic and international relations,adhering to the balance of righteousness and benefit oriented by new development at the domestic level,and constructing a new pattern of global governance led by the new frontier at the international level.The promotion of the underlying logic of legislation in emerging fields must adhere to systemic thinking and systemic conception,and the construction of a horizontal typology and vertical hierarchical model of intertwined and immersed systemic promotion,following the holistic,scientific,democratic and professional legislative thinking and practical methods.
