摘要
“审判管理现代化”的提出,不仅意味着审判管理被法院系统赋予更重要的意义,也表明其存在较大改革发展空间。当下的审判管理体系由以控制案件处理流程为着力点的过程约束、以调控案件实体裁判为落脚点的实体把控与以考评审判质效为出发点的考核管理构成。在法院运行复杂的制度结构中,控制逻辑、合法性逻辑与责任逻辑构成审判管理存续的制度逻辑,它们也赋予审判管理正当性与合理性。“审判管理现代化”指明了审判管理发展的方向,明确审判管理的功能限度、调整审判管理的对象与定位以及构建审判管理的责任机制,应该成为推进审判管理转型发展的重要方面。
The proposal of“the modernization of judicial management”not only signifies that the court system has assigned greater importance to judicial management,but also indicates that there remains substantial room for its reform and development.The current judicial management system consists of process constraints focused on controlling case handling procedures,substantive control aimed at regulating case judgments,and evaluation management centered on assessing judicial quality and efficiency.In the complex institutional structure of court operations,control logic,legitimacy logic,and accountability logic form the institutional basis for the existence of judicial management,granting it legitimacy and rationality.“The Modernization of judicial management”outlines the direction for its development,clarifies the functional limits of judicial management,adjusts the objects and positioning of judicial management,and emphasizes the construction of an accountability mechanism for judicial management.These should become key aspects in advancing the transformation and development of judicial management.
