摘要
互联网的发展使劳动者下班后被工作消息侵扰的现象屡见不鲜。当现有法律拙于应对远程办公带来的挑战,离线权作为拥有独立内涵的权利又亟待被确认,有必要运用法教义学解释之方法,对离线权进行二次定位。经由对法律规则的逻辑分析,离线权与休息权、私生活安宁权存在权能重合,涵盖休息自决与生活安宁两大法益。在权利实现方式上,通过对休息权的扩张性解释,劳动者拥有了休息自决的权利,可对非工作时间的联络主张停止侵害。实践中隐形加班的司法认定能克服远程办公模式下加班的隐蔽性,保障加班加点费用的给付。当权利侵扰达到一定程度时,劳动者还可主张损害赔偿以维护其身心健康与生活安宁。紧急情况下,劳动者亦需负担容忍义务,以忠诚勤勉之态度向更高位阶的法益让渡。
The growth of the Internet has encroached on workers’personal time.While the right to disconnect act as an independent right and requires legal recognition,existing legal frameworks prove inadequate to address the challenges.Consequently,it is necessary to employ legal doctrinal analysis and redefine the right.Under the comparison of the legal rules,the right to disconnect overlaps with the right to rest and the right to privacy and tranquility,covering two major legal interests:the right to self determination in rest and the tranquility of life.In terms of realizing the right,an expansive interpretation of the right to rest grants workers the legitimate entitlement to disconnect after work and to demand the cessation of any violations.Judicial recognition of invisible overtime can also overcome the hidden nature of overtime under remote work arrangements and ensure the payment of overtime compensation.When the infringement reaches a certain threshold,workers may also claim damages to protect their physical and mental health as well as their peace of life.In some urgent situations,workers are required to bear a duty of tolerance and,with loyalty and diligence,concede to higher-ranking legal interests.
