摘要
旨在探讨“双碳”目标背景下中国甘蔗糖业绿色发展的法治路径,解决当前存在的立法层级低、监管协同不足及市场激励机制缺失等关键问题。基于甘蔗糖业可持续发展的内生需求与“双碳”目标的外部约束,系统梳理国内法律政策体系,并借鉴巴西、印度、澳大利亚、泰国等主要产糖国的立法与政策经验,为我国相关制度的完善提供参考。研究揭示了我国甘蔗糖业绿色发展面临三大法治困境:缺乏高位阶专门立法、监管职能分散、碳汇市场机制不健全。据此提出以科学规划立法体系、强化执法监督效能、构建糖业碳交易机制和完善财税激励政策为核心的系统性法治对策。建立健全法治保障体系是推动甘蔗糖业深度融入国家“双碳”战略的根本途径。通过系统性制度设计实现产业发展与生态保护的有机统一,可为行业绿色转型提供持续制度动能,最终达成环境效益与经济效益协同提升的发展目标。
This study aims to explore the legal pathways for the green development of China's sugarcane industry under the“Dual Carbon”goals,addressing key issues including low legislative hierarchy,insufficient regulatory coordination,and lack of market incentive mechanisms.Based on the endogenous needs for sustainable development of the sugarcane industry and the external constraints of the“Dual Carbon”goals,it systematically examines the domestic legal and policy framework,drawing on the legislative and policy experiences of major sugar-producing countries such as Brazil,India,Australia,and Thailand,to provide insights for improving China's relevant systems.The research reveals three major legal challenges facing the green development of China's sugarcane industry:the lack of high-level specialized legislation,fragmented regulatory functions,and underdeveloped carbon sink market mechanisms.Accordingly,it proposes systematic legal countermeasures centered on scientifically planning the legislative system,strengthening enforcement and supervision effectiveness,establishing a carbon trading mechanism for the sugar industry,and improving fiscal and tax incentive policies.Establishing a sound legal safeguard system is identified as the fundamental approach to deeply integrate the sugarcane industry into the national“Dual Carbon”strategy.Through systematic institutional design that achieves the organic unity of industrial development and ecological protection,sustained institutional momentum can be provided for the industry's green transition,ultimately realizing the developmental goal of synergistic enhancement of environmental and economic benefits.
