摘要
我国数字法学教育陷入“形式理性”的科学主义误区,过度推崇法教义学逻辑与计算工具理性,致使教育脱离数字社会场景,难以平衡技术效率与人文价值。数字法学教育需立足本土实际,以人文主义调适科学主义,通过意识形态、方法论与法律思维的协同革新,培养兼具技术能力、法律素养与人文关怀的复合型数字法治人才。在具体路径上,需推动学科建设、课程设置与教学方式三维协同。一方面,优化“法律硕士+跨学科”模式,增设社会科学课程以强化学科价值基础,调整传统部门法以聚焦数字时代核心问题,设计融合课程以平衡技术与人文关系。另一方面,可以通过课题训练培育批判思维,依托交叉学科平台塑造系统思维,推动数字技术从“形式理性主导”转向“人本价值赋能”。
China's digital-law education has fallen into the"formal rationality"pitfall of scientism and put an excessive emphasis on legal dogmatic logic and computational instrumental rationality,which leads to its detachment from digital social context,making it difficult to achieve the balance between technological efficiency and humanistic value.Regarding digital-law education,it is necessary to be based on domestic reality,refine scientism with humanism,and cultivate interdisciplinary talents in digital rule of law featuring technological ability,legal literacy and humanistic care through the coordinated reform of ideology,methodology and legal thinking.In terms of specific paths,it is necessary to promote three-dimensional coordination between discipline construction,curriculum setting and teaching methods.For one thing,it is necessary to optimize the model of"Juris Master+interdisciplinarity",increase courses on social sciences to strengthen the basis of disciplinary value,adjust traditional areas of law to focus on core issues in the digital era,and design integrated courses to balance the relationship between technology and humanities.For another,it is able to cultivate critical thinking through project-based training,shape systematic thinking on basis of interdisciplinary platforms,and transform digital technology from"dominance by formal rationality"to"empowerment by human-centered value".
