摘要
政府采购企业数据是政府与企业签订数据采购合同,运用财政资金购买政府履职所需企业数据的活动。政府采购企业数据不仅能够促进数据要素市场健康良性发展和有效激发企业开放数据资源意愿,而且还能够合理平衡政府与企业的权责关系,契合深化数据要素市场化配置改革的发展方向。法制是政府采购企业数据的重要保障,现有政府采购企业数据的法律体系存在采购主体范围界定过窄、市场准入条件模糊、采购方式设置不合理以及监督管理机制滞后等不足。我国应当以适应数据交易的创新发展为导向,完善政府采购的法律体系,为政府采购企业数据提供充分的法制化保障。
Government procurement of enterprise data refers to the activity of signing data procurement contracts between the government and enterprises,and using fiscal funds to purchase enterprise data required for government performance.Government procurement of enterprise data can not only promote the healthy and benign development of the data element market and effectively stimulate the willingness of enterprises to open up data resources,but also reasonably balance the rights and responsibilities between the government and enterprises,which is in line with the development direction of deepening the market-oriented allocation reform of data elements.The rule of law is an important guarantee for government procurement enterprise data.The existing legal system for government procurement enterprise data has shortcomings such as narrow definition of the subject scope of government procurement enterprise data,vague market access conditions,unreasonable procurement methods,and lagging supervision and management mechanisms.China'should improve the legal system of government procurement with the orientation of adapting to the innovative development of data transactions,and provide sufficient legal protection for government procurement enterprise data.
