摘要
[研究目的]数字经济推动下,全球数据跨境流动规模不断扩展,企业数据的安全风险随之加剧,具体表现为合规性风险,以及因原始数据增值带来的价值风险。通过分析企业数据跨境流动中的合规性安全隐患和数据增值的安全风险,可为企业数据安全风险治理策略提供参考。[研究方法]基于案例分析法和DIKW链(Data-Information-Knowledge-Wisdom)理论,分析D公司APP下架事件与T平台事件中的数据跨境流动安全风险,探讨数据规制差异下的原始数据合规性风险,以及国家安全视域下由原始数据增值引发的安全风险。[研究结论]随着数据在DIKW链中的增值,风险呈现积累、变异和放大的特点,这不仅影响企业数据在跨境流动过程中的合规性问题,也可能对国家安全产生潜在威胁。为了提高企业数据跨境流动的安全治理能力,企业可以通过数据风险评估、数据访问控制、数据跨境流动监控与应急管理,以及数据合规意识和能力分层次培训等方式加强数据控制和合规性管理。
[Research purpose]Driven by the digital economy,the scale of global cross-border data flows continues to expand,leading to escalating security risks for corporate data.These risks manifest as compliance hazards and value risks stemming from the added value of raw data.By analyzing compliance vulnerabilities and security risks associated with data value enhancement in cross-border data flows,this study aims to provide insights for corporate data security risk management strategies.[Research method]Employing case analysis and the DIKW(Data-Information-Knowledge-Wisdom)chain theory,this study examines security risks in cross-border data flows during the Company D APP suspension and T Platform issue.It explores compliance risks associated with raw data under divergent regulatory frameworks and security threats arising from raw data value enhancement within the national security context.[Research conclusion]As data appreciates along the DIKW chain,risks exhibit characteristics of accumulation,mutation,and amplification.This not only impacts compliance issues during cross-border data flows but may also pose potential threats to national security.To enhance security governance capabilities for cross-border data flows,enterprises can strengthen data control and compliance management through data risk assessment,data access control,monitoring and emergency management of cross-border data flows,and tiered training programs on data compliance awareness and capabilities.
