摘要
地震预警是应对突发地震灾害的重要措施,其有效运行不仅依赖技术进步,更需要制度保障。本文通过分析地震预警的技术特征与制度需求,揭示地震预警治理中存在的法律规制碎片化与责任失衡等现实问题,提出“技术-制度”协同治理框架。本研究认为,需通过技术治理的制度嵌入、完善层级分明的立法体系,形成技术与制度互相促进和优化的双向机制,更好地实现地震预警社会效益最大化。
Earthquake early warning(EEW)is a critical technical tool for mitigating the impacts of sudden seismic events. Its effective operation depends not only on technological innovation but also on robust institutional frameworks. By analyzing both the technical characteristics and institutional requirements of EEW,this study identifies key challenges,including fragmented legal regulations and uneven distribution of responsibilities in system governance. To address these issues,a “technology-institution” collaborative governance framework is proposed. The study argues that integrating institutional considerations into technical governance,improving the hierarchical legislative system,and establishing a two-way mechanism for the mutual reinforcement of technology and institutional arrangements. This is essential for maximizing the societal benefits of EEW systems.
