摘要
数字经济时代,算力作为新型核心生产要素,与算法和数据共同构成了数字经济发展的基础性支撑。以某公司安某恶意挖矿案为研究样本,当前算力资源刑事司法保护面临三大困境:一是算力法律属性界定不清,导致保护依据不足;二是算力损失认定缺乏科学统一的评估标准;三是单纯适用计算机类犯罪规制路径难以全面评价行为的危害性。针对这些问题,提出系统性完善方案:在规范层面,应当明确算力的财产权属性,构建计算机犯罪与财产犯罪并行的双重规制体系;在司法实践层面,建议以算力本身的市场价值为基础,建立科学合理的损失计算规则,旨在为算力资源的合法利用构建完善的刑事保障机制,从而有效促进数字经济的健康有序发展。
In the era of digital economy,computing power,together with algorithms and data,has become a core production factor and a fundamental pillar of digital economic development.Using the malicious mining case of a technology company as a research sample,this paper indentifies three major dilemmas in the current criminal protection of computing power resources:1)the unclear legal status of computing power leads to insufficient grounds for protection;2)the lack of a scientific and unified standard for assessing losses hinders accurate identification of harm;and 3)reliance solely on the regulatory path of computer crimes fail to fully capture the harmfulness of such conduct.To address thses issues,the paper proposes a systematic improvement scheme.At the normative level,the property rights attribute of computing power should be clarified,and a dual regulatory system combining computer crimes and property crimes should be constructed.At the judicial practice level,it is recommended that the market value of computing power itself serve as the basis for establishing a scientific and reasonable rules for loss calculation.The ultimate goal is to build a sound criminal proection mechanism for the lawful use of computing power resources,thereby effectively promoting the healthy and orderly development of digital economy.
