摘要
标准与专利本属不同领域,但随着技术发展与标准化创新持续推进,专利被纳入技术标准的现象日益普遍。二者的融合催生了标准必要专利,其认定对标准的制定与实施至关重要。当前,我国在标准必要专利认定上尚缺乏统一规范。为推进国内标准必要专利制度建设,本文结合实践经验,系统阐述了标准必要专利认定的关键步骤、注意事项,并辅以实例说明,旨在为相关研究与应用提供参考与探讨基础。
Standards and patents belongs to distinct domains.However,with technological advancement and continuous innovation in standardization,it is increasingly common for patents to be incorporated into technical standards.This convergence has given rise to Standard Essential Patents(SEPs),whose identification is crucial for both the development and implementation of standards.Currently,China lacks a unified regulatory framework for SEP identification.To advance the development of China’s SEP system,this paper,based on practical experience,systematically outlines the key steps and critical considerations of SEP identification,supplemented with examples for illustration.It aims to provide a reference and discussion basis for related research and application.
