摘要
国家公园生物资源管护公私合作是迈向生态共同体的必然选择。国家公园生物资源管护的公私合作路径,是指将社会参与机制运用到公共利益导向的国家公园生物资源管护过程之中。生态共同体理念下,传统行政主导型管护模式在规范体系建构、权责边界厘定、收益分配规则、风险分担机制、争议解决程序等方面尚存瑕玷,难以匹配现实需要。在国家公园生物资源管护与公私合作是否适配的理论议题上,政府职能的持续转型、规范及实践基础的不断夯实、公私主体的互动融合等要素,为二者的和谐共生培育了新的制度土壤。鉴于此,应进一步为国家公园生物资源管护公私合作提供法律支持和政策保障,合理划分公私主体间的权责边界,建立公平稳定的利益分配机制,健全严密而灵活的风险分担机制,设置明确透明的争议解决程序,使之不断趋向生态共同体的理想化合作图景。
Exploring public-private partnerships(PPPs)for the stewardship of biological resources in national parks is an inevitable choice for moving toward an ecological community.The PPP pathway in this context denotes the deployment of mechanisms for social participation within a public-interest-oriented process of biological resource stewardship in national parks.Under the ecological-community paradigm,the traditional administration-led stewardship model remains deficient in multiple respects,specifically the construction of a coherent normative framework,the delineation of power-responsibility boundaries,the design of benefit-sharing rules,the arrangements for risk allocation,and the procedures for dispute resolution,and it is thus ill-suited to practical needs.Regarding the theoretical compatibility between biological-resource stewardship in national parks and PPPs,the ongoing transformation of governmental functions,the progressive consolidation of normative and practical foundations,and the interactive integration of public and private actors together cultivate an enabling institutional environment for their harmonious co-evolution.Accordingly,PPPs for the stewardship of biological resources in national parks should be further underpinned by legal support and policy guarantees;the boundary of powers and responsibilities between public and private actors should be reasonably demarcated;fair and stable benefit-sharing mechanisms should be established;robust yet flexible risk-sharing mechanisms should be improved;and clear,transparent dispute-resolution procedures should be instituted,so that practice progressively approaches the ideal cooperative configuration envisaged by the ecological community.
