摘要
近年来,人工智能生成内容(Artificial Intelligence Generated Content,AIGC)技术改变了内容生产模式。佛山文创产业在借助AIGC实现创新转型的同时,亦面临着潜在的版权风险。为应对佛山文创企业面对算法黑箱带来的责任界定困境与潜在的跨法域治理难题,文章引入玛格丽特·博登的创造力理论,将风险映射为组合式、探索式与变革式三类,进而构建了一套兼顾制度稳健性与产业可操作性的“分层治理+区块链确权与取证+跨法域协同平台+基金支持”的解决方案,以期助力佛山文创产业及全国同类型制造业城市应对AIGC带来的版权挑战。
In recent years,artificial intelligence generated content(AIGC)has reshaped modes of content production.While leveraging AIGC to pursue innovation and transformation,Foshan’s cultural and creative industries also face latent copyright risks.To tackle attribution dilemmas stemming from algorithmic opacity and the attendant challenges of cross-jurisdictional governance,the paper introduces Margaret A.Boden’s theory of creativity to map risks into three categories—combinational,exploratory,and transformational—and proposes a solution portfolio that balances institutional robustness with industrial operability:layered governance,blockchain-enabled rights attribution and evidentiary preservation,a cross-jurisdictional coordination platform,and a dedicated funding mechanism.The framework aims to support Foshan’s cultural and creative sector—and manufacturing-oriented cities across China with similar profiles—in responding to the copyright challenges posed by AIGC.
