摘要
监察留置在取代“双规”后虽实现了法治化转型,但仍面临证据合法性不足、权利救济缺位和监督制约乏力等结构性困境。查留分离既契合程序公正与比例原则的规范要求,也体现政治合法性与治理现代化的制度需求。在经验层面,我国的侦押分离和看守所中立化改革已提供了制度经验;在比较法上,大陆法系通过侦查与羁押分离来分权,英美法系依靠司法令状制度来强化外部监督,二者在价值取向上均体现了对权力制衡与程序公正的共同追求;在制度架构上,应通过并入看守所体系实现场所独立化,以权限分置来保障权力制衡,并通过类型化监督和律师介入强化权利保障,同时,还需借助刑事诉讼程序的有效衔接与渐进式制度建构提升体系的协调性。
Although supervisory custody has achieved a degree of legalization by replacing the“shuanggui”practice,it still faces structural challenges,including insufficient evidentiary legitimacy,inadequate rights remedies,and weak oversight and constraints.The separation of investigation and custody not only aligns with the normative requirements for procedural justice and the principle of proportionality but also reflects institutional demands for political legitimacy and governance modernization.Empirically,China's reforms of separating investigation from custody and promoting the neutrality of detention centers have provided institutional experience.From a comparative law perspective,civil law systems enforce a division of powers through the institutional separation of investigative and detention functions,while common law systems strengthen external oversight through judicial warrant mechanisms.Both demonstrate a shared commitment to power checks and procedural fairness.In terms of institutional design,supervisory custody should be incorporated into the detention center system to ensure site independence,authority segmentation should be implemented to guarantee checks and balances,and rights protection should be enhanced through typified oversight and lawyer involvement.Meanwhile,effective procedural connectivity with the criminal justice system and a gradual construction of supporting institutions are necessary to improve overall systemic coherence.
