摘要
随着互联网技术的迭代升级和数字经济的蓬勃发展,网络账号、游戏装备、虚拟货币、NFT等新型网络衍生物日益受到社会公众的关注。网络虚拟财产是计算机信息技术发展的产物,其概念范围、法律属性、权利义务内容等均较为复杂,在理论界和实务界尚存在较大争议。同时,其保护规则不够明确,司法实践中时常出现游戏账号被盗后维权困难、虚拟货币交易纠纷无法可依等问题。文章基于民商法视角,对虚拟财产的法律定义和保护路径进行系统研究,进而提出完善虚拟财产确认规则、细化赔偿标准、建立纠纷解决机制等建议。在民商法上明确虚拟财产的法律地位和保护规则,有助于减少司法裁判的分歧,进而最大限度地保护公民的数字财产权利,促进数字经济的健康有序发展。
With the iteration and upgrading of Internet technology and the vigorous development of digital economy,new network derivatives represented by online accounts,game equipment,virtual currency and NFTs are garnering increasing public attention.Virtual assets are a product of the development of computer information technology,and there is still considerable controversy in both theoretical and practical circles concerning its conceptual scope,legal attributes,rights and obligations due to its complexity.At the same time,its protection rules are ambiguous,leading to frequent issues in judicial practice,including difficulties in rights protection after game accounts are stolen,and disputes over virtual currency transactions lacking legal provisions.Based on the perspective of civil and commercial law,this article systematically studies the legal definition and protection path of virtual assets,and proposes suggestions for perfecting the rules for confirming virtual assets,refining compensation standards and establishing dispute resolution mechanisms.Clarifying the legal status and protection rules of virtual assets in civil and commercial law can help reduce judicial disputes,thereby maximizing the protection of citizens'digital property rights and facilitating the sound and orderly development of the digital economy.
