摘要
以“结构—过程”为范式,以Y省柏乡田村推行新时代“枫桥经验”治理法治化的实践过程为样本,利用法律人类学“扩展个案”方法,折返于静态与动态之间、宏观与微观之间、必然与偶然之间,分别从内在原理与实践机理角度,可以提炼出新时代“枫桥经验”法治化路径的“内化循环”之“道”与“有机互嵌”之“术”。要在“道”与“术”的有机统一中实现修复社会关系、重塑社会信任、增强社会联结之目的,让基层之治超越社会性,迈向深嵌于公共性中的有机团结共同体,为中国之治贡献新时代“枫桥经验”法治化路径的重要载体和关键保障。
Using the“structure-process”paradigm as a framework and the practice of implementing the New Era Fengqiao Experience in Tiancun Village,Boxiang Township,Y Province as a case study,this research applies the legal-anthropological method of the“extended case study”to navigate between statics and dynamics,macro and micro levels,and necessity and contingency.From the perspectives of underlying principles and practical mechanisms,it distills the Dao(principle)—the“internalization cycle”—and the Shu(technique)—the“organic embedding”—of the Path to the Rule of Law informed by the New Era Fengqiao Experience.Through the organic unity of Dao and Shu,this approach seeks to repair social relations,rebuild social trust,and strengthen social bonds.It enables grassroots governance to move beyond purely social management toward an organically solidary community deeply embedded in public life,thereby providing an important vehicle and key safeguard for China's governance through the Path to the Rule of Law informed by the New Era Fengqiao Experience.
