OBE理念下中国法制史课程教学改革——以汉朝“亲亲得相首匿”制度翻转课堂为例

摘要 在新文科建设与法治人才培养的双重背景下,中国法制史作为法学专业核心基础课程,面临教学理念滞后、方法单一、学生主动性不足、与现实脱节等困境,难以实现“德法兼修”的育人目标。成果导向教育(OBE)理念以学生综合能力提升为核心,强调“以终为始”的教学设计;翻转课堂则通过“课前预习+课上互动”的模式重构教学流程,二者的融合为中国法制史教改提供了有效路径。本文以汉朝“亲亲得相首匿”制度为例,系统设计OBE理念下的翻转课堂教学方案,从预习、讨论、总结、拓展四个环节落实“知识掌握—能力培养—素质提升”的递进式目标,同时针对课程教改困境提出“理念革新—内容优化—方法创新—评价完善—师资强化”的对策体系,为提升中国法制史教学质量、培养兼具文化自信与法治思维的高素质法律人才提供实践参考。 Against the dual background of the construction of"New Liberal Arts"and the cultivation of legal talents,History of Chinese Legal System,as a core basic course for law majors,faces difficulties such as outdated teaching concepts,single teaching methods,insufficient student initiative,and disconnection from reality,making it difficult to achieve the educational goal of"cultivating talents with both moral integrity and legal professionalism".The Outcome-Based Education(OBE)concept focuses on the improvement of students̓comprehensive abilities and emphasizes"beginning with the end"in teaching design;flipped classroom reconstructs the teaching process through the model of"pre-class preview+in-class interaction".The integration of the two provides an effective path for the teaching reform of History of Chinese Legal System.Taking the system of"Concealment of Offenses Among Family Members"in the Han Dynasty as an example,this paper systematically designs a flipped classroom teaching plan under the OBE concept,and implements the progressive goals of"knowledge mastery—ability cultivation—quality improvement"through four links:preview,discussion,summary,and expansion.At the same time,aiming at the difficulties in the course teaching reform,it proposes a countermeasure system of"concept innovation—content optimization—method innovation—evaluation improvement—teacher team strengthening",providing practical reference for improving the teaching quality of History of Chinese Legal System and cultivating high-quality legal talents with both cultural confidence and legal thinking.
