摘要
临时用地管理对于提升土地要素服务和保障能力,满足建设项目施工、地质勘查等各类用地需求至关重要。然而,在土地资源日益紧张、政策制度不断趋紧、管控措施愈发严密等多重约束条件下,如何满足超大城市建设项目施工等辅助性用地需求,已成为当前临时用地管理亟待深入研究的重要议题。本文选取深圳市作为典型案例,遵循“历程演进—发展困境—实践路径—思考建议”的逻辑主线,回顾了深圳市临时用地管理的演进历程,并深度剖析了用地保障困难、政策限制与需求矛盾、审批流程复杂及监管难度大等临时用地管理实践困境。为应对挑战,深圳市创新性地提出了拓宽临时用地来源、创新短期租赁政策、优化审批机制,以及强化监督管理等实践路径。在此基础上,以因地制宜、守正创新、精准查治为导向,进一步提出面向超大城市临时用地管理的改革意见,以期促进城市土地资源的高效利用和可持续发展。
Temporary land use management is crucial for enhancing the service and support capabilities of land elements,as well as meeting various land use demands for construction projects,geological surveys and other purposes.However,under multiple constraints such as increasingly scarce land resources,stricter policies and regulations and tighter control measures,how to fulfill the auxiliary land use needs for construction projects in megacities has become an important issue that urgently requires in-depth research in temporary land use management.This paper selects Shenzhen,a megacity,as a typical case,and follows the logical framework of"evolutionary process-developmental dilemma-practical pathway-reflection and suggestion".It reviews the evolution of Shenzhen's temporary land use management and deeply analyzes the practical dilemma in temporary land use management,including difficulties in land use security,conflicts between policy restrictions and demand,complex approval processes,and challenges in supervision.To address these challenges,Shenzhen has innovatively proposed practical pathways such as broadening the sources of temporary land,creating short-term leasing policy pathways,optimizing approval mechanisms,and strengthening supervision and management.Meanwhile,based on these efforts and guided by the principles of adapting to local conditions,adhering to innovation and precise governance,this paper further puts forward reform suggestions for temporary land use management in megacities,aiming to promote the efficient utilization and sustainable development of urban land resources.
