摘要
诉讼、仲裁与调解被喻为商事纠纷解决的“三驾马车”。理想的商事纠纷解决格局应当是“三驾马车”并驾齐驱,充分发挥各自的解纷优势。然而,实践考察发现,商事调解在组织、案源、效力、费用等方面,均不同程度地依附于诉讼或者仲裁。长此以往,不仅可能限制商事调解的发展空间,而且有可能消减商事调解的独立价值与核心优势;进而导致商事调解行业生态难以形成,商事纠纷解决体系的结构失衡,以及与国际商事调解发展趋势的背离。传统“诉讼中心主义”结构的制约、商事调解解纷效能的相对不足、资源配置的不充分是造成商事调解依附性发展的深层原因。唯有从结构转型、效能提升、资源整合三个维度协同推进,才能实现商事调解由依附性发展向自主性发展迈进。
Litigation,arbitration,and mediation are often described as the"three horses pulling the carriage"of commercial dispute resolution.The ideal landscape of commercial dispute resolution should be one where these"three horses"run side by side,fully leveraging their respective advantages in resolving disputes.However,empirical observations reveal that commercial mediation is to varying degrees dependent on litigation or arbitration in terms of organization,case sources,enforceability,and costs.If this situation persists,it may not only restrict the development of commercial mediation but also erode its independent value and core strengths,thus further leading to the difficulty in forming a viable ecosystem for the commercial mediation industry,structural imbalance in the commercial dispute resolution system,and deviation from the international commercial mediation development trend.At its root,the deep-seated reasons for the dependence-oriented development of commercial mediation lie in the constraints of traditional"litigation-centered"structure,the relatively insufficient efficacy of commercial mediation in resolving disputes,and the inadequate resources allocation.Only by promoting coordinated advancement from three dimensions,i.e.structural transition,efficacy improvement,and resource integration,can the transition of commercial mediation be realized from dependent development to independent one.
