《中华人民共和国食品安全法》修正案解读与实务建议

摘要 2025年9月12日,十四届全国人大常委会第十七次会议审议通过了关于修改《中华人民共和国食品安全法》的决定。本次修法聚焦重点液态食品道路散装运输和婴幼儿配方液态乳监管两个突出问题,构建全链条监管体系。本文在分析核心修改内容的基础上,结合上海市食用植物油生产运输现状,从监管与共治、现状与未来、部门与地方等维度分析了修改条款的意义,论述了修改方向的合理性,并进一步从运输容器核验标准的精细化、处罚梯度的科学化调整、新增运输过程信息的数字化监管、新规落地的多重措施保障等方面对具体条款进行了辨析。 On September 12,2025,the 17th Session of the Standing Committee of the 14th National People's Congress deliberated and passed the decision to amend the Food Safety Law.This revision targets two critical issues:the bulk road transportation of specific liquid food products and the enhanced supervision of infant formula liquid milk,establishing a comprehensive whole-chain regulatory framework.Based on an analysis of the core amendments and contextualized within the current landscape of edible vegetable oil production and transportation in Shanghai,this article examines the implications of the revised provisions from multiple dimensions,including regulatory enforcement and collaborative governance,present challenges and future developments,and the roles of central agencies versus local authorities.It argues for the rationale behind the revision's direction and offers a detailed critique of specific clauses.This critique focuses on refining the verification standards for transport containers,proposing a more scientifically calibrated penalty system,implementing digital monitoring of transportation process information,and outlining multiple measures to ensure the effective implementation of the amended draft.
