摘要
在现阶段的审查实践中,对于一些权利要求冗长、技术效果变劣的专利申请,审查方式较为单一,审查效率较低。文章针对权利要求冗长、技术效果变劣的专利申请,以实用性“积极效果”作为立足点,采用最接近现有技术,判断等同技术特征是否具有积极效果,从而判断该类专利申请是否具有实用性,进而能够提高处理该类专利申请的效率,达到提高专利授权质量的目的。
In the current patent review process,for some patent applications with lengthy claims and deteriorating technical effects,the reviewing method is relatively simplistic and the efficiency is low.Targeting patent applications with lengthy claims and deteriorating technical effects,the article takes the“positive effects”requirement for utility as a foothold,and uses the closest prior art to determine whether equivalent technical features have positive effects,in order to judge the utility of such patent applications.This can boost the efficiency of handling such patent applications and enhance patent grant quality.
