摘要
随着互联网技术的不断发展,网络虚拟财产的价值认定问题逐渐成为法学研究的热点与难点。当前网络虚拟财产价值认定在理论与实践中存在诸多分歧。通过对现有认定方式的剖析,可以发现各类方法均有其适用场景与局限性,因此应当引入新的价值认定方法。在马克思劳动价值论的框架下,网络虚拟财产价值的形成与用户的数字劳动和运营商的数字劳动密切相关,故在其价值认定时,应充分考虑劳动要素。由于不同类型网络虚拟财产的劳动要素有所差异,故需要对网络虚拟财产进行分类认定,依据类型的不同,构建起差异化的价值认定体系。
With the advancement of Internet technology,the valuation of virtual network property has become a hot and challenging topic in legal research.Currently,there are numerous discrepancies in the theory and practice of online virtual property valuation.Through an analysis of existing valuation methods,it is evident that each method has its applicable scenarios and limitations,so new valuation methods should be introduced.Within the framework of Marx′s labor theory of value,the formation of the value of virtual network property is closely related to the digital labor of users and operators.Therefore,labor elements should be fully considered in the valuation.Given the variations in labor elements across different types of virtual network property,it is necessary to categorize virtual network property and establish a differentiated valuation system.
