摘要
低空经济作为新兴产业,推动了全球技术创新与经济增长,但其公法保障尚未得到充分研究。低空空域作为领土的延伸,其管理涉及国家安全、公共秩序、环境保护以及经济发展等多重需求。低空空域的自然资源属性及其权属问题仍需进一步探讨。空域使用权与管理权是构建低空经济法治框架的核心,必须在保障国家安全的基础上,平衡经济增长与社会利益。低空经济的快速发展也带来了新的法律挑战,急需平衡技术进步与公民权益保护,特别是保障因低空飞行活动而遭受“特别牺牲”的居民合法权益。通过建立收益分享机制、建设低空空域基础设施并实施合理补偿措施,可以有效缓解低空经济带来的财产权冲突与隐私侵犯,从而推动低空经济的可持续发展。
As an emerging industry,the low-altitude economy has spurred global technological in-novation and economic growth,yet its public law guarantee has not been thoroughly explored.The low-altitude airspace,as an extension of territorial space,involves multiple demands related to na-tional security,public order,environmental protection and economic development in its manage-ment.Nevertheless,the natural resource attributes of low-altitude airspace and issues concerning its ownership rights remain subjects for further discussion.The rights to use and manage airspace con-stitute the core of establishing a legal framework for the low-altitude economy,which must balance economic growth with social interests while guaranteeing national security.The rapid development of the low-altitude economy has also posed new legal challenges,necessitating a balance between technological advancement and the protection of citizens’rights and interests,particularly in guaran-teeing the legitimate rights and interests of residents who endure“special sacrifices”due to low-al-titude flight activities.By establishing a revenue-sharing mechanism,constructing low-altitude airspace infrastructure and implementing reasonable compensation measures,conflicts over proper-ty rights and privacy infringements arising from the low-altitude economy can be effectively mitigat-ed,thereby promoting its sustainable development.
