摘要
在社会救助体系由“保生存”向“保基本、防风险、促发展”转变,行政程序强调权利保障也要重视效能优化的背景下,传统从“过程”视角梳理的最低生活保障行政调查程序难以满足实践发展和理论更迭的需要。推动行政互动的规范化和有效化,需要全面审视“权利保障型”和“效能导向型”两类程序并论证其法律控制之道。最低生活保障行政调查程序中的事前告知程序、民主评议程序和信息公开程序体现权利保障,而调查时限制度、在线申请程序和信息核对平台则彰显着效能导向型程序的价值,但二者均存在治理困境,亟待解决。基于此,本文采用两条路径对调查程序的设计予以优化,设计出既能保障相对人权利,又简单、灵活、迅速且合乎行政目的的程序,防止最低生活保障中的适格公民因烦琐程序而无法及时获得行政给付。
With the transformation of the social assistance system from“ensuring survival”to“ensuring basic living,preventing risks,and promoting development”,and with the emphasis on both the protection of rights and the optimization of efficiency in administrative procedures,the traditional administrative investigation procedure of minimum living security,which has been sorted out from the“process”perspective,is difficult to meet the needs of practical development and theoretical evolution.To promote the standardization and effectiveness of administrative interaction,it is necessary to comprehensively examine and discuss the legal control methods from two types of procedures:the“right-protection-oriented”and the“efficiency-oriented”procedures.The prior notification,democratic evaluation,and information disclosure procedure in the administrative investigation procedure for minimum living security reflect the protection of rights,while the investigation time limit system,online application procedure,and information verification platform highlight the value of the efficiency-oriented procedure.However,both orientations face governance dilemmas that urgently need to be addressed.Based on this,this article adopts two approaches to optimize the design of the investigation procedure.A procedure is proposed that not only protects the rights of the interested parties but is also simplified,flexible,rapid,and aligned with the administrative purpose.This aims to prevent eligible citizens in the minimum living security from failing to receive administrative payments in a timely manner due to cumbersome procedures.
