摘要
目前,生态保护红线在全国范围内已经全面划定并进入实施的关键期,但如何在适应制度理念和要求的情况下保障公众权益仍处在探索期。国家出台若干意见要求强化对生态保护红线的管控与监督检查,但实践中,由于地方缺少相应的公众参与程序以及缺乏对生态保护红线的制约监督机制,导致存在公众知情权模糊、决策权缺位以及监督权缺失等困境,提出保障知情权、保障决策权、完善监督体系等法制保障进路。
Currently,ecological red lines have been comprehensively delineated throughout the country and have entered the critical period of implementation,but how to safeguard public rights while adapting to the institutional concepts and requirements remains still in the exploratory period.The state has issued several opinions calling for strengthening the control,supervision and inspection of the ecological redlines.However,in practice,due to the lack of corresponding public participation procedures and restriction and supervision mechanism for ecological red lines,there are some dilemmas such as the ambiguity of the public’s right to know,the absence of decision-making power and the lack of supervision power.Therefore,this paper proposes legal safeguard pathways such as ensuring the right to know,guaranteeing decision-making rights,and improving the supervision system.
