摘要
我国高校学生管理经历了规范化管理期、制度化管理期和科学化管理期三个阶段,实现了从权利保障缺位、重视程序性权利到关注个性化权利的转变,体现了逐步走向权利解放的秩序变迁逻辑。宏观的政治经济体制转型、相关法律法规的出台与变更、文化价值观的发展以及行动者之间的博弈是驱动《普通高等学校学生管理规定》秩序变迁、促进学生权利解放的重要因素。《普通高等学校学生管理规定》在成本效应、学习效应和协调效应等因素的共同作用下所产生的自我强化,导致其变迁呈现强劲的路径依赖,阻碍了学生的权利解放,但在路径依赖中也实现了层叠式、漂移式和转换式的渐进性秩序变迁。未来高校学生管理要进一步明晰管理边界,防范高校越权行为;确立纪申委的设立原则,确保管理的程序正义;探索高校“处分期间”制度,平衡教学秩序与学生权益。
The management of students in colleges and universities in China has gone through three stages:standardized management period,institutionalized management period and scientific management period.It has achieved a shift from the absence of rights protection,attaching importance to procedural rights,to focusing on individual rights,reflecting the logic of order change towards gradual liberation of right.The transformation of the macro political and economic system,the introduction and change of relevant laws and regulations,the development of cultural values,and the game between actors are important factors driving the changes in the Regulations on the Administration of Students in Colleges and Universities and promoting the liberation of students'rights.The selfreinforcement of the Regulations on the Administration of Students in Colleges and Universities under the combined effect of cost effect,learning effect,and coordination effect has led to strong path dependence in its changes,which has hindered the liberation of students'rights,but it has also achieved incremental changes in layered,drifting,and transformational ways within the path dependence.In the future,the management of students in colleges and universities should further clarify the boundaries of management,standardize the process of university management,innovate the public management of university disciplinary actions,and explore the post-disciplinary management in universities.
