摘要
国内外目前对艺术法虽无确切的定义,但是艺术市场发展中产生的大量法律问题迫切需要艺术法回应和解答。中国学界对艺术法的研究起步较晚,比较偏重对知识产权的研究,对艺术市场法律研究关注不足,远未形成系统的理论体系。仅有的立法成果主要集中在文物保护、拍卖和著作权领域,相对滞后的立法不能满足快速发展的艺术市场的需求。学界应注重对艺术法的关注和研究。
Although there is no precise definition of art law both domestically and internationally,the numer-ous legal issues arising from the development of the art market urgently require art law to respond and provide solutions.Research on art law in China began relatively late,with a greater emphasis on intellectual property rights research and insufficient attention to legal studies of the art market,resulting in an incomplete theoret-ical framework.The limited legislative achievements are primarily concentrated in the areas of cultural relics protection,auctions,and copyright.The relatively lagging legislation fails to meet the demands of the rapid-ly developing art market.Threfore,it is imperative for the academic community to prioritize attention and research on art law.
