摘要
保障公众健康是我国环境立法的重要旨归,以环境健康利益为核心的环境健康权是保障公众健康的重要权利载体。就环境健康权入典议题而言,环境健康权与生态环境法典编纂间存在着密切的逻辑关联。环境健康权的法典表达可在契合法典编纂“总则—分编”体例的基础上,借用适度化的立法模式,采用“一体两翼”的入典路径。在总则编,就环境健康权的内涵界定、权责分配及损害救济等内容进行说明;在污染防治编,就公众环境健康权的制度保障问题进行详细阐述;在生态环境责任编,对公众环境健康权的损害救济问题展开探究。通过对环境健康权入典的逻辑理路与规范构造展开研究,可以为环境健康权的法定化提供必要的理论参考。
Safeguarding public health is a key objective of China's environmental legislation.Environmental health rights,centered on environmental health interests,serve as an important carrier for protecting public health.Regarding the inclusion of environmental health rights in the code,there is a close logical connection between these rights and the compilation of the Environmental and Ecological Code.The codification of environmental health rights can follow the"General Provisions-Subsections"structure,adopt a moderate legislative model,and take a"one body with two wings"path.In the General Provisions,define their connotation,allocate rights and responsibilities,and specify remedies;in the Pollution Prevention Subsection,elaborate on institutional safeguards;in the Ecological and Environmental Liability Subsection,explore damage remedies.This study provides theoretical references for legalizing environmental health rights.
