摘要
随着5G通信、云计算与人工智能等数字技术的发展与深度融合,劳动形态正经历革命性重构。数字赋能一定程度上改变了当代劳动者的工作方式,极大提高了劳动的效率,然而也带来了劳动者工作时空边界加速消解,离线权难以维护的境况。当“永远在线”损害劳动者权益的现象发生时,确立劳动者“离线权”已从理论命题升维至法治刚需。本文在此背景下将从“离线权”的相关理论概述、当前中国构建离线权的困境及建构路径三个维度入手,意在助力我国离线权的立法保护进程,为劳动法治现代化提供范式创新,保障劳动者的相关权益。
With the development and deep integration of digital technologies such as 5G communication,cloud computing and artificial intelligence,the form of labor is undergoing a revolutionary reconstruction.Digital empowerment has to some extent changed the working methods of contemporary workers and greatly improved labor efficiency.However,it has also led to the accelerated dissolution of the spatiotemporal boundaries of workers’work and the difficulty in maintaining offline rights.When the phenomenon of“always online”infringing upon the rights and interests of workers occurs,establishing workers’“offline rights”has been elevated from a theoretical proposition to a necessity of the rule of law.Under this background,this article will start from three dimensions:An overview of the relevant theories of“offline rights”,the current predicament of constructing offline rights in China,and the construction path,aiming to assist in the legislative protection process of offline rights in our country,provide paradigm innovation for the modernization of labor rule of law,and safeguard the relevant rights and interests of workers.
