摘要
检察机关提前介入职务犯罪监察调查,是监察体制改革后监检工作衔接的重要内容。监检“互相配合、互相制约”关系为提前介入提供了宪法依据,以破解重大、疑难、复杂职务犯罪案件的定罪量刑难题为逻辑起点,其法理基础在于检察机关为履行审查起诉职能,在案件进入审查起诉程序前介入调查,确保案件事实清楚、证据确实充分。监察体制改革以来,提前介入机制的制度规范不断完善,实践探索不断深入,但是由于目前实务部门对于检察机关提前介入监察调查的认识仅停留在操作层面,这一机制在制度化设计上尚存在不够明朗之处,应从明确适用条件、完善启动机制、规范工作方式、健全反馈机制等方面予以完善。
The early intervention of the prosecution in the supervision and investigation of duty-related crimes is an important part of the connection between supervision and prosecution work after the supervision system reform.The relationship of“mutual cooperation and mutual restriction”between supervision and prosecution provides a constitutional basis for early intervention.Starting from the logical starting point of solving the conviction and sentencing problems of major,difficult and complex duty-related crime cases,its legal basis lies in that the prosecution,in order to perform the function of prosecution review,intervenes in the investigation before the case enters the prosecution review procedure to ensure that the facts of the case are clear and the evidence is sufficient.Since the supervision system reform,the institutional norms of the early intervention mechanism have been continuously improved,and the practical exploration has been continuously deepened.However,because the current practical departments’understanding of the prosecution’s early intervention in supervision and investigation only stays at the operational level,there are still some unclear points in the institutional design of this mechanism,and it should be improved from the aspects of clarifying the application conditions,perfecting the starting mechanism,standardizing the working methods and improving the feedback mechanism.
