摘要
新质生产力依赖创新驱动,高质高效的创新创造成果离不开知识产权的保护。与新质生产力相关的新兴科技领域尚缺乏明确的法律规定,受限于漫长的立法时间及程序,需要发挥知识产权能动司法的作用。知识产权司法通过法律解释方法、灵活适用法律,消解刚性立法与复杂社会现实之间的张力,使新质生产力发展得到妥当保障,通过强化能动司法,加强部门合力,将严格保护创新的理念贯穿于知识产权司法始终,不断完善技术调查官制度,在专业鉴定机构的协力之下,加强对高新技术成果的前瞻性保护,通过对创新者权益的司法保护,不断激励创新,促进生产要素活力迸发,创新源泉充分涌流。
New-form productive forces rely on innovation-driven development.High-quality,efficient innovation,creation,and their outcomes depend fundamentally on robust intellectual property protection.Emerging technology fields related to new-form productive forces currently lack clear legal provisions.Due to lengthy legislative processes,proactive intellectual property adjudication should play a crucial role.Through interpretive legal methodologies and flexible application of the law,intellectual property adjudication mitigates the tension between rigid legislation and complex social realities,ensuring appropriate safeguards for the development of new-form productive forces.By strengthening proactive justice and enhancing synergy among departments,consistently uphold the principle of strictly protecting innovation throughout intellectual property adjudication.Continuous improvements to the technical investigator system should be made and supported by specialized appraisal institutions,while the forward-looking protection of advanced technological achievements should be strengthened.Through judicial protection of innovators’rights,innovation should be persistently incentivized,so as to unleash the vitality of production factors and fully unlock the wellspring of innovation.
