摘要
竞争政策与竞争执法的关系密切。竞争政策是社会主义市场经济的基础性政策,与市场决定资源配置相辅相成。市场竞争依赖自发机制,作为政府行为的反垄断和反不正当竞争应当谦抑,而不能强化。当前竞争执法存在常识和立场偏差、专业性不足及外部干扰等问题。其改革,须强化说理及宗旨条款、原则条款、概括条款、兜底条款的运用;建立行业监管机构与专门执法机构的协同机制,在管辖权上遵循“特殊优先、一般兜底”的原则。竞争执法救济应当对竞争执法机构适用竞争法的实体规范,以保障竞争政策的有效实现。
Competition policy and competition law enforcement are closely related.Competition policy is a basic policy of the socialist market economy,and complements the policy of letting the market determine resource allocation.Market competition relies on the spontaneous order,therefor anti-monopoly and anti-unfair competition as government actions should be“modest”,rather than to be strengthened.Current competition law enforcement confronts problems such as deviation from common sense and position,lack of professionalism and excessive external interference.Its reform must resort to strengthening the use of reasoning based on the purpose clause,the principle clauses,the general clause,and umbrella clauses,establishing a coordination mechanism between industry regulatory agencies and specialized competition law enforcement agencies,and following the principle of“lec specialis derogat legi generali”The(re-)evaluation of competition law remedies imposed by competition law enforcement agencies should be based on substantive norms of competition law,thereby ensuring the effective implementation of competition policy.
