摘要
人类命运共同体理念所倡导的国际社会整体观、可持续发展观与共商共建共享原则所蕴含的共享理念、和谐价值与可持续发展原则指引国际投资法,要求国际投资法更应该坚持主权国家与投资者之间的利益平衡,注重国际整体利益和人类共同利益;从简单强调投资自由化保护转向更加关注可持续发展;国际投资争端化解机制也将从单一仲裁方式走向投资争端预防、投资仲裁和调解的多元结合,最终实现国际投资法范式从自由主义向共享主义的深刻转型。
The Concept of a Community with a Shared Future for Mankind advocates the over-all perspective of the international community,the concept of sustainable development,and the prin-ciple of“extensive consultation,joint contribution and shared benefits”.It has successfully em-bedded the concept of sharing,the value of harmony,and the principle of sustainable development.This requires that international investment law should adhere more firmly to the balance of interests between sovereign states and investors,and give due weight to the overall international interests and the common interests of humanity.It should shift from simply emphasizing the protection of invest-ment liberalization to paying more attention to sustainable development.The mechanism for resolv-ing international investment disputes will also evolve from a single arbitration approach to a diverse combination of investment dispute prevention,investment arbitration,and mediation,ultimately achieving a profound transformation of the paradigm of international investment law from liberal-ism to sharing-based ideology.
