摘要
交通公共数据作为智慧城市建设的核心,其数据的充分共享开放尤为重要。然而,目前在数据权属界定、数据责任划分等方面存在诸多现实问题,导致公共数据流通受阻。探讨交通行业公共数据确权的现状、挑战,总结国内外在数据确权上的经验,指出需要构建多维保护机制,以平衡数据保护与自由流动的关系。同时,基于交通行业公共数据的特点,提出相适应的数据权利主体、划分方式,探讨数据权限与责任的框架,对来源于政府和企业的公共数据确权路径分别进行讨论,并以上海交通行业公共数据融合应用为例,为公共数据的资源化迈出探索性的一步。
As a core component of smart city development,the full sharing and open access of transportation public data is particularly critical.However,in practice,numerous issues remain in defining data ownership and clarifying data responsibilities,which hinder the effective circulation of public data.This paper explores the current status and challenges of confirming rights for transportation public data,summarizes domestic and international experiences in data rights attribution,and emphasizes the need to establish a multidimensional protection mechanism to balance data protection with free flow.Based on the characteristics of transportation public data,the paper proposes suitable rights holders and classification approaches,examines the framework of data rights and responsibilities,and discusses differentiated rights confirmation paths for government-derived and enterprise-generated public data.Using Shanghai's transportation data integration practices as a case study,the paper takes an exploratory step toward the resource-based governance of public data.
