摘要
知识产权哲学的逻辑起点是缘何为知识赋权的问题。为知识设定权利,需要进一步思考知识产权的合理性基础、部门法的内在法理及基于国家战略的制度建构。罗马法“羊皮交易”与中国宋代“版权之利”蕴含了知识产权的合理性萌芽。“李约瑟之谜”和“苹果的故事”反映出对知识产权本质主义的追问在界定财产定义及边界上的基础作用。知识产权权利构造是一种功能主义的建构,需要统合各部门法法理,并与社会治理理论同构。权利实现中,应积极应对现实中知识产权类型化不足、权利属性模糊等所导致的请求权基础不明确问题。为回应科技发展与时代变迁,对知识创新的界权要坚持主客观结合论,同时处理好权利保护与知识共享之间的平衡。
The philosophical inquiry into intellectual property is fundamentally concerned with the justification for endowing rights in knowledge.The establishment of such rights necessitates a deeper examination of the normative foundations of concerned intellectual property,the underlying jurisprudential principles within specific legal domains,and the institutional construction based on national strategy.Early expressions of intellectual property rationality can be discerned in the Roman“parchment transactions”(羊皮交易)and the Song Dynasty’s concept of“copyright interests”(版权之利).The“Needham Puzzle”(李约瑟之谜)and the“Apple Narrative”(苹果的故事)highlight the critical role of essentialist inquiries into intellectual property in defining the nature and boundaries of property.The rights construction of intellectual property is inherently functionalist,requiring the integration of jurisprudential principles across legal domains and the coherence with social governance theory.To realize these rights,proactive measures are needed to address practical challenges arising from inadequate typification and ambiguous rights attributes,which obscure the basis for claims.To respond to technological advancement and epochal change,we must adhere to the dual-aspect theory of subjective-objective integration in the delineation of rights over knowledge innovation while balancing rights protection with knowledge dissemination.
