摘要
随着市场经济持续发展,我国商标侵权纠纷日益增多,无论原告、被告还是审判员,都存在估算注册商标专用权合理赔偿数额的需求。估算权利人因被侵权所受到的实际损失通常需要具备相关专业领域知识,明确其合理估算方式具有必要性。本文拟就注册商标专用权侵权合理赔偿数额估算过程中权利人因被侵权所受到实际损失的估算方法予以简要探讨。
With the continuous development of the market economy,trademark infringement disputes in China are increasing day by day.Whether it is the plaintiff,defendant,or judge,there is a need to estimate the reasonable compensation amount for the exclusive right to use a registered trademark.Estimating the actual losses suffered by the rights holder due to infringement usually requires knowledge in relevant professional fields,and it is necessary to clarify their reasonable estimation methods.This article intends to briefly explore the estimation method of the actual losses suffered by the right holder due to infringement in the process of estimating the reasonable compensation amount for trademark exclusive rights infringement.
