摘要
敦煌争讼文书充分反映了晚唐五代宋初归义军政权统治敦煌时期民间纠纷解决的真实图景和民事诉讼制度。因为五代宋初时期的敦煌归义军政权沿袭唐代民事诉讼制度,所以敦煌争讼文书成为研究唐代民事诉讼制度的一手档案文献,彰显出我国传统法律文化中的基层治理智慧。分析代表性的敦煌争讼文书可以发现唐代民事诉讼制度具有以下特点:遵循起诉、立案审查、作出判决的规范性流程,综合运用书证、物证、当事人陈述、勘验记录等多种证据形式查明案件事实,恪守诉讼时效及审理期限,确保当事人受侵害的权利得以救济。研究敦煌争讼文书,有助于揭示唐代民事诉讼制度所蕴含的关于纠纷解决的传统法文化智慧,为新时代法治中国建设进程中多元解纷机制的构建提供有益借鉴。
The litigation documents of Dunhuang fully reflect the civil litigation system during the period when the Guiyi military regime ruled Dunhuang in the late Tang,Five Dynasties and early Song Dynasties.As the Dunhuang Guiyi military regime during the Five Dynasties and Early Song Dynasties continued to use the civil litigation system of the Tang Dynasty,the litigation documents of Dunhuang have become the first-hand original archival documents for studying the civil litigation system of the Tang Dynasty.The litigation documents of Dunhuang fully demonstrate the true picture of the resolution of civil disputes in the late Tang,Five Dynasties and early Song Dynasties,highlighting the wisdom of grassroots governance in the excellent traditional Chinese legal culture.Through the analysis of representative Dunhuang litigation documents,the following characteristics of the Tang civil litigation system can be observed:adhering to a standardized process from lawsuit filing,case filing and review,to judgment;comprehensively utilizing various forms of evidence,including documentary evidence,physical evidence,party statements,and inspection records,to ascertain case facts;strictly abiding by mandatory provisions on statute of limitations and trial duration to ensure prompt remedy for infringed rights of the parties.The study of Dunhuang litigation documents contributes to the in-depth exploration and application of excellent traditional Chinese legal culture resources,reveals the traditional legal wisdom for dispute resolution embedded in the civil litigation system of the Tang Dynasty,and benefits the construction of a diversified dispute resolution mechanism in the process of building a rule-of-law China in the new era.
