摘要
如何平衡好个人健康医疗数据保护与共享应用,已成为我国健康医疗数据突破发展瓶颈必须考虑的问题。从多元主体协同治理的视角出发,通过对我国个人健康医疗数据共享现状进行剖析,探讨其面临的挑战及成因,并提供对策和建议。我国的个人健康医疗数据共享存在数据授权信任危机、数据使用风险隐患、数据监管制度缺失等三重难题亟待解决,这就需要在树立数据安全与隐私安全底线意识的前提下,分别从数据授权主体、数据处理主体和数据监管主体3个层面探索应对策略。相应的,加强主体认知协同、破除数据提供者信任危机,优化数据市场管理协同、实现数据“静态管理”转向“动态应用”,推进法律与政策治理效用协同、落实配套性支撑政策等措施的运用为问题的解决提供了可供借鉴的思路。
How to balance personal health data protection and sharing applications has become the bottleneck of the development of health data in our country that must be considered.From the perspective of multi-subject collaborative governance,it has analyzed the current situation of personal health data sharing in China,discussed the possible challenges and causes,and provided countermeasures and suggestions.There are three major challenges in personal health data sharing in China,including the trust crisis in data authorization,potential risks in data use,and the lack of a regulatory system.These problems need to be solved by exploring countermeasures from three perspectives:data authorization subjects,data processing subjects,and data regulatory subjects,with the premise of establishing a bottom-line awareness of data security and privacy protection.In response,enhancing cognitive coordination among stakeholders,breaking the trust crisis faced by data providers,optimizing the management coordination of the data market,shifting from"static management"to"dynamic application",and promoting the synergy of legal and policy governance and implementing supporting policies are all measures that can provide useful insights into solving the problem.
