摘要
人权尽责概念为联合国《工商业与人权指导原则》首次提出,其生成推动了全球工商业与人权治理范式发生转换。人权尽责强调,公司应当承担与自身实力和影响力相匹配的人权责任以预防和消除其负面影响。由于其主张日益为国际社会所认同,人权尽责演变为全球工商业与人权治理的通用语言。法国通过推出《企业警戒义务法》,率先把人权尽责从国际理念与软法性原则转变为国内法律制度,并以警戒计划为基石,开创性地创建带有三维结构实施机制的强制性公司人权尽责制度。《企业警戒义务法》公司人权尽责不仅引领全球工商业与人权治理立法,而且塑造其标准,同时还产生了显著的域外效应,从而对我国产生重大而深远的影响。对此,我国要科学设计其因应之策,其中包括加快完善国内工商业与人权立法,力争掌握全球工商业与人权治理规则制定的主导权。
The concept of corporate human rights responsibility was first introduced in the United Nations Guiding Principles on Business and Human Rights,which sparked a shift in the global paradigm of business and human rights governance.Corporate human rights responsibility emphasizes that companies should assume human rights responsibilities commensurate with their power and influence to prevent and eliminate negative impacts.As this principle has gained increasing recognition globally,human rights responsibility has evolved into a universal language for international business and human rights governance.France has taken the lead by enacting the Duty of Vigilance Law,transforming the concept of human rights responsibility from an international idea and soft law principle into a domestic legal system.Based on the vigilance plan,it has innovatively created a mandatory corporate human rights responsibility system with a three-dimensional implementation mechanism.The Duty of Vigilance Law not only leads global business and human rights governance legislation but also shapes its standards.Furthermore,it has generated significant extraterritorial effects,having a profound and far-reaching impact on China.In response,China should scientifically design appropriate countermeasures,including speeding up the improvement of domestic business and human rights legislation,and striving to take the lead in shaping global business and human rights governance rules.
