摘要
【目的】为打破高校专利许可信息壁垒,促进专利开放许可制度在河南有效落地实施,需要进一步探索并完善具体实施路径。【方法】以河南省高校为研究对象,通过实地调研各高校的专利转移转化情况,结合实证研究、文献分析和政策研究,探索河南省专利开放许可的实施路径。【结果】河南高校在专利转化过程中存在积极性不高,研发方向与市场需求不匹配,信息交流渠道不畅及激励政策缺乏等问题。河南省具备坚实的政策基础来支持高校专利开放许可的实施,探索开放许可实施路径符合高校专利转移转化的实际需求,并可为开放许可的制度落地和推广提供经验。【结论】在借鉴国内先进试点高校经验的基础上,河南应面向全省高校建立专利开放许可平台,完善激励和引导机制,增加资金投入,组建专业专利转化团队,强化交易监管,并设立专利保险,以保障河南高校专利开放许可的顺利实施。
[Purposes]To break down the information barriers in university patent licensing and facilitate the effective implementation of the patent open licensing system in Henan,it is essential to further ex⁃plore and refine specific implementation pathways.[Methods]Focusing on universities in Henan Prov⁃ince,this study investigates patent transfer and transformation through field research.By combining em⁃pirical research,literature analysis,and policy studies,it explores the implementation path of patent open licensing in the region.[Findings]Henan universities face challenges in patent transformation,in⁃cluding low motivation,misalignment between research and market demand,inefficient information ex⁃change,and insufficient incentive policies.However,Henan Province possesses a solid policy foundation to support patent open licensing in universities.Exploring open licensing pathways aligns with the practi⁃cal needs of patent transfer and transformation,while also offering insights for the system′s broader implementation and promotion.[Conclusions]Drawing on the experience of leading pilot universities in China,Henan should establish a province-wide patent open licensing platform,improve incentive mechanisms,increase funding,assemble professional patent transformation teams,strengthen transaction oversight,and introduce patent insurance to ensure the smooth implementation of open licensing in its universities.
