摘要
程颢、程颐作为宋明理学的奠基者,在北宋法律体系稳定而成熟的背景下,构建了一套完整的理学法哲学体系。在理论层面,“二程”以“天理”为哲学的最高范畴,赋予法以理论根源,即“法自理出”;同时融贯“变易”之道,保证法的动态性与稳定性。在实践层面,“二程”在人性论基础上讨论德刑关系,讲求在制刑、用刑中遵循人之“气禀”;将“执中”贯通于法刑的制定与执行,强调法治与伦理的平衡。在礼法合一层面,“二程”淡化了儒家传统中的法律工具主义色彩,追求以规范引导主体,实现道德自觉同天道秩序相合,具有深刻的内在超越性意义。
As the founders of Song-Ming Neo-Confucianism,Cheng Hao and Cheng Yi developed a comprehensive legal-philosophical system within Neo-Confucianism against the backdrop of a stable and mature legal framework in the Northern Song dynasty.This system can be interpreted through the following dimensions:on the theoretical level,Cheng Hao and Cheng Yi elevated natural law as the supreme philosophical category.This concept provided law with a metaphysical foundation,that is law arising from reason.Additionally,they integrated“change”to ensure the dynamic adaptability and stability of legal norms.On the practical level,based on their theory of human nature,the Cheng brothers discussed the relationship between virtue and punishment,advocating that the formulation and application of punishments should align with the“temperament”of people.They emphasized“upholding the principle and being unfair”in both the creation and enforcement of laws,aiming to balance the rule of law with ethical considerations.On the level of the unity of rites and laws,Cheng Hao and Cheng Yi shifted away from the instrumentalist view of law within Confucian tradition.Instead,they pursued a normative framework that guides individuals to harmonize their moral consciousness with the way of Heaven.This approach carries profound significance in terms of immanent transcendence.
