摘要
数字时代,平台滥用市场支配地位行为虽然会产生限制竞争的消极影响,但很大程度上也会产生多方面的积极影响。此时,传统的适用除外判断标准已无法解决现实反垄断执法问题,需要进行标准的重新设定。在深刻把握数字时代发展趋势的基础上,以比例原则为判断框架,将创新和效率价值作为首要判断标准,辅以作为时代判断标准的数据安全,再结合公平的要求准确界定反垄断法适用除外的判断标准。
In the digital era,the abuse of market dominance by platforms no longer only has the negative impact of restricting competition,but to a large extent has a multifaceted positive impact.At this time,the traditional judgement standard of applying the exclusion can no longer solve the real antitrust enforcement problems,and it is necessary to reset the standard.On the basis of a profound grasp of the development trend of the digital era,the principle of proportionality should be used as the judgement framework,and the values of innovation and efficiency should be taken as the primary judgement criteria,supplemented by data security as the judgement criterion of the era,and then combined with the requirements of fairness to accurately define the judgement criteria for the exclusion of the application of the anti-monopoly law.
