摘要
在艾滋病防控中,维护社会整体的健康安全与保障个体公民的基本权益,理应形成一种相辅相成、内在一致的价值追求。这不仅是艾滋病防治策略所应秉持的核心原则,更是构建和谐社会秩序的基石。然而,在艾滋病防控过程中,防控部门往往基于公共健康安全的价值衡量,采取强制性的传统行政措施,以牺牲公民的某些权利为代价,如限制就业机会、侵犯个人隐私等,从而引发艾滋病防控背景下公共健康安全与公民权利之间的矛盾。鉴于此,为了有效化解这种矛盾,须要在公共卫生治理领域中引入合作治理理论,以弥合公权与私权之间的裂隙。具体来说,明确艾滋病防控的规范依据、激活合作治理体制、创新合作治理防控方式、建立良好合作治理程序、健全严格的责任体系,来平衡艾滋病防控中公共健康安全与公民权利的冲突。
In the prevention and control of AIDS,it is important to maintain both the overall health security of society and safeguard the basic rights of individual citizens to form a mutually reinforcing and internally consistent values.This is not only the core principle that AIDS prevention and treatment strategies should uphold,but also the cornerstone of building a harmonious social order.However,in the AIDS prevention and control process,public health departments often adopt mandatory traditional administrative measures based on the value assessment of public health security,sacrificing certain rights of citizens such as employment opportunities and personal privacy.Consequently,this triggers conflicts between public health security and citizens rights in AIDS prevention and control.To effectively resolve such conflicts,it is necessary to introduce the theory of collaborative governance in the field of public health to bridge the gap between public authority and private rights.Specifically,it involves clarifying the normative basis for AIDS prevention and control,activating a collaborative governance system,innovating collaborative governance prevention and control methods,establishing sound collaborative governance procedures,and strengthening a strict accountability system to mitigate the conflicts between maintaining public health security and safeguarding citizens'rights during AIDS prevention and control process.
