摘要
最大诚信原则主要是为了解决保险合同双方对于保险标的风险和合同内容可能存在的信息不对称问题。在此原则之下,保险合同双方都需履行特定的义务,包括投保人、被保险人一方的信息提供与危险控制义务,以及保险人关于保险合同内容的说明与保险金及时给付义务。由本文的研究可知,随着保险科技的广泛应用,保险人有越来越多的途径可以了解与直接控制风险,其对于说明义务与理赔义务的履行方式也随之有了显著的变化,因此在新技术背景下,为贯彻最大诚信原则需进一步加强对保险人的约束。就具体规则设计而言,结合《保险法》第五次修改的背景,有必要通过部分保险合同法规则和监管规则的微调,适当减轻投保人、被保险人一方的信息提供义务,并合理确立保险人的危险控制与咨询提供义务。
The principle of utmost good faith aims to solve the problem that the information asymmetry exists between the different parties of insurance contract about the risk of insurance subject and contract content.Under this principle,both parties of insurance contract assume specific obligations,including the insured party's obligations to provide information and control risks,as well as the insurer's obligations to provide information on contract and pay insurance money on time.According to the research in this paper,not only do insurers have more ways to know and control risks directly,but also the fulfillment status insurers perform obligations to provide information and pay insurance money has changed with the development of insurtech.In order to implement the principle of utmost good faith under the background of new technology,it is necessary to impose more constraints on insurers.In the future,it is important to release the burden on the insured party's obligations to provide information and emphasize the insurers'duty to control risks along with providing consultations by means of the slight adjustment of rules on insurance contract law and insurance regulation under the background of the fifth revision of insurance law.
