摘要
在大数据时代背景下,个人信息所蕴含的商业价值与社会价值呈现出爆发性增长。然而,这同时伴随着信息泄露风险的加剧和侵权事件的发生。行政监管作为守护个人信息安全的关键屏障,在维护公民合法权益和规整数据市场秩序方面,发挥着不可替代的重要作用。本研究对大数据时代个人信息保护行政监管的现状进行了全面剖析,发现存在监管主体权责边界不明确、法律规制体系存在漏洞、技术监管水平有待提升等诸多挑战。针对这些问题,建议采取以下措施:明确监管主体的职能,完善法律法规架构,提升技术监管效能,以构建科学合理且高效运转的行政监管体系。这一体系将为筑牢个人信息安全防线提供坚实的理论支撑和实践指导。
In the context of the big data era,the commercial and social value contained in personal information has shown explosive growth.However,this is accompanied by the increasing risk of information leakage and the occurrence of infringement incidents.Administrative supervision,as a key barrier to safeguard personal information security,plays an irreplaceable role in safeguarding the legitimate rights and interests of citizens and regulating the order of the data market.This study comprehensively analyzed the current situation of administrative supervision of personal information protection in the era of big data,and found that there are many challenges such as unclear boundaries of regulatory rights and responsibilities,loopholes in the legal regulatory system,and the need to improve the level of technical supervision.To address these issues,it is recommended to take the following measures:clarify the functions of regulatory bodies,improve the legal and regulatory framework,enhance the efficiency of technical supervision,and build a scientific,reasonable,and efficient administrative supervision system.This system will provide solid theoretical support and practical guidance for building a strong defense line for personal information security.
