摘要
随着全球贸易保护主义抬头和区域性经贸壁垒增加,美欧等国对外资安全审查更加严格,产业政策向本土企业倾斜,全球产业链供应链正在重构。我国新能源海外投资及相关权益保护面临的不确定性和风险不断上升,而现行新能源海外投资权益保护机制尚不健全,法律保护工具、投资管理机制、风险对冲工具以及信息与中介服务等方面仍存在诸多局限性,难以有效应对国际投资规则变化和东道国监管政策收紧带来的风险。因此,应加快构建高水平海外投资法律保障体系、构建公正合理透明的国际投资规则体系、强化政企协同管理机制、优化保险服务体系、提升投资信息与中介服务能力,系统性提升新能源海外投资权益保护能力,更好地维护新能源海外投资权益,以推动我国新能源企业高质量出海。
With the rise of global trade protectionism and the increase in regional economic barriers,foreign investment security reviews have become more stringent,industrial policies are increasingly favoring domestic enterprises,and the global industrial and supply chains are undergoing restructuring.As a result,Chinese overseas investments in the new energy sector face growing uncertainty and risks.Current mechanism for protecting overseas investment in the new energy sector remains underdeveloped,with significant limitations in legal protection tools,investment management mechanisms,risk hedging instruments,and information and intermediary services.These shortcomings make it difficult to effectively respond to changes in international investment rules and the tightening of host country regulatory policies.To better safeguard overseas investment interests and promote high-quality global expansion of enterprises in the new energy sector,it is essential to establish a high-level legal protection system,build a fair,rational,and transparent international investment rules framework,strengthen the governmentbusiness coordination management mechanism,optimize the insurance service system,and enhance investment information and intermediary service capabilities.
